After 4 years of standing up to one of the giants in the insurance industry, Mid-Continent Casualty Co., Lamar Homes won a 6-3 decision in the Supreme Court. We owe a special thanks to our list of supporters. You got the message out by filing amicus briefs and writing/publishing numerous articles describing how Mid-Continent and a lot of the insurance industry was denying coverage and attempting to redefine the wording within their policies after the polices were purchased. What does this mean to you? Insurance companies have now been put on notice that they can and will be held accountable and must stand behind the Commercial General Liability policies that they sell to everyone involved in the building industry. If a subcontractor unintentionally causes damage to a home, now there will be coverage. (We’re proud to have been building for 20 years in Austin with only 2 such occurrences.) This Supreme Court decision gives added protection to homebuyers, builders, and subcontractors! “It is not often that a small business wins in court against a large, national insurance company,” said Harry Savio, executive vice-president of the Austin Home Builder’s Association. “It’s a true David and Goliath scenario. Since 87% of the HBA’s members are small businesses, this is an important feat for the industry.”
